TERMS AND CONDITIONS FOR MAKING RESERVATIONS
II) The contract for other activities or services is between the client and the provider of the service or activity (the provider). III) The contract will come into existence when VIA SUR dispatches CONFIRMATION OF BOOKING to the client. IV) The contract will be governed by Spanish law and will be subject to the jurisdiction of the Spanish courts.
2. TERMS OF PAYMENT VIA SUR will issue a CONFIRMATION OF BOOKING on receipt of a deposit equal to 25% of the total cost. The CONFIRMATION OF BOOKING will confirm receipt of the deposit and detail the amount due as a FINAL PAYMENT. FINAL PAYMENTS are due 42 days before the commencement of the reservation. If we do not receive payment in full and on time, we reserve the right to treat the reservation as cancelled by the client. In this case the cancellation charges are set out in clause 4. Where bookings are made and accepted less than 42 days before the start of the holiday, the full price is payable at the time of the booking.
3. PRICES AND SURCHARGES All our prices are in EUROS and, we hope, represent excellent value for money. We provide accommodation in some of the finest houses in Eastern Andalucia at stable and realistic prices. We include heating costs in all low season prices. Heating is optional at other times on payment of a supplement here. Please note that Spanish national holidays are charged at mid season prices and heating is charged accordingly. We will only apply surcharges if costs increase by more than 2% as a result of government action. Should the surcharges applied exceed 10% of the cost of the booking, the client will be entitled to cancel the booking with a full refund. The right to cancel must be exercised within 14 days of the date of the surcharge invoice.
Any cancellation must be made in writing. The cancellation will apply from the date VIA SUR receives the written cancellation. Cancellations sent by fax or e-mail are acceptable. Cancellation charges are as follows: High and mid season I) cancellation more than 42 days before the commencement date: deposit only; II) cancellation less than 42 days before the commencement date: 100% of all costs; Low season I) cancellation more than 42 days before the commencement date: deposit only; II) cancellation 41 to 30 days before the commencement date: 50% of all costs; III) cancellation less 30 days before the commencement date: 100% of all costs;
Should VIA SUR be unable to provide the accommodation booked by the client, we will offer either alternative accommodation of an equal or better standard, or a full refund of all monies paid.
6. AMENDMENTS BY THE CLIENT Where a client wishes to amend arrangements after VIA SUR has issued a CONFIRMATION OF BOOKING, we will do everything possible to meet the request. However, in such circumstances we reserve the right to treat amendments to the accommodation or dates as a cancellation by the client. Amendments to the number in the party will normally be accepted without charge. However, under no circumstances will VIA SUR accept any bookings amendments which exceed the maximum number of persons stated in the property description.
7. YOUR RESPONSIBILITIES a) the reasonable care of the property during your stay. b) any damage to the property, its contents or to any Third Party visiting the property, which is caused by you, or any member of your party, or any person invited by you to the property. c) at the end of the rental period the property must be left secured with all doors and windows locked and all electrical and gas appliances switched off.
8. OUR RESPONSIBILITIES VIA SUR takes great pride in the quality of the accommodation which it offers and in the attention to detail given to the maintenance of its properties. We accept responsibility for: a) providing the accommodation in the property booked by the client; b) the cleanliness and maintenance of the property as described in Clauses 8,d and 10,b; c) the acts and omissions of our employees. However, VIA SUR acts as an agent and cannot be held responsible for the acts and omissions of property owners, carriers or providers of services, nor can we be held responsible for events outside our control. We strongly recommend that all clients ensure that all members of their party obtain appropriate travel and personal insurance. d) For rental periods longer than ten nights clean sheets and towels will be provided mid stay or every 7 days for visits over 14 nights in duration. Extra cleaning is available on request at a cost of 8.50€ per hour.
We hope that our clients are highly satisfied with their accommodation and services and that there are no complaints. We work hard to preempt any difficulties which might arise during your stay. However, if your are dissatisfied with your accommodation or any of the services for which we act as agent, we ask you to contact us as soon as possible on any of the contact numbers which we will provide. We will strive to resolve any difficulty immediately, however, should you remain dissatisfied at the end of your stay, we will continue to resolve complaints, providing that they are notified to us in writing within 15 days of the end of the holiday.
10. OTHER INFORMATION a) Houses are available from 16:00 on the day of arrival and must be vacated by 10:00 on the morning of departure. b) The Viasur office is open for key collection from 16:00 until 19:00 weekdays and from 15:30 until 19:00 on saturdays. Please note that an extra charge is made for late arrivals, from Monday to Saturday: From 19:00 to 21:00, 20 € From 21:00 to 00:00, 30 € After 00:00, 50€ Sundays and national holidays: All day up to 21:00, 20 € From 21:00 to 00:00, 30 € After 00:00, 50€ c) In order to keep the houses, pools and gardens in peak condition for all guests, it is necessary for agency staff to visit the house during your stay. This may include gardeners who will need to water the gardens, (April to October) and the pool cleaners who have to maintain the pool once or twice a week. d) If extra firewood is required, delivery can be arranged within 24 to 48 hours. Please contact Viasur. e) Viasur cannot be held responsible for any noise pollution beyond our control in the environs of the rental house. f) Lost property: Personal items
left by clients in the rental house will be kept for two weeks, after
which time they will be disposed of.
